DIAL AFRIKA'S PRIVACY POLICY

At Dial Afrika, we care deeply about your privacy, we take it as well as its security seriously. We believe in transparency and we are committed to being upfront about our privacy practices including how we treat your personal information. This Privacy Policy outlines how Dial Afrika Inc and its affiliates (collectively, " Dial Afrika," "we," "our," or "us" ) process the information we collect about you through our websites, mobile apps, and other online services (collectively, the "Services") and when you otherwise interact with us, such as through our customer service channels.

This policy applies to information we collect and which we are controller of:

  • Through your interactions with the Service or Software, including, but not limited to your creation and storage in the Service of information relating to your account information, Agent contact information, your customers (including customer contact information) and location data and dispatch information (including GPS data);
  • On the Website, Mobile Application; Developer portal, Our social media pages and any other websites we operate (collectively, called our "Digital Properties")
  • In telephone call recordings, e-mail, text and other electronic messages to us or routed through the Service, including, but not limited to attachments, documents and files submitted through the website;
  • Through mobile and desktop applications that provide dedicated non- browser-based interaction between you and the Service or portions of the Service; and

  • by us offline or through any other means, including information given to us from referral partners and trade organizations, or on any other website operated by the Company or any third-party; or

2. INFORMATION COLLECTION

When you visit our site and interact with our services in our various different digital platforms, we collect several types of information as enumerated below:

  1. Identity Data- These include your name, date of birth, aliases, postal address, internet protocol (IP) address, account or user name, government-issued identification documents, social media identifiers or any other relevant identifiers.

  2. Financial Records Data- These include your payment card and bank account details. We may involve third party processors whilst processing this information.

  3. Contact Information Data -These include information such as your email address and phone number

Internet activity and other Device Information- These include information as regards your search and browsing history, device information and its operating system, its cellular provider and any other information collected when you use the internet to interact with our digital properties. We may use cookies and other tracking technologies to collect some of the information enumerated.

  5. Employment Related Information -These include information about your employer company, your title in the company, the company information and address.

  6. Information about your Location- These include information such as exact location from your mobile device and IP addresses.

  7. Additional Data you Provide or We Collect -These include recordings of interacting with our sales and support teams or customer support chat logs, survey responses, information you provide by filling in forms on the site, copies of your correspondence when you contact us, details of interactions you perform on the site for the purchase of subscription plan and fulfilling your subscription order.

3. HOW WE COLLECT THE DATA

a). Information we Collect Automatically

When you visit our site and use our service, we may automatically collect some information that includes:

  1. Usage Information -These are information about your activity on our services that includes device identifiers (i.e., IP address or device identifiers) features you use, the date and time you accessed site and any other relevant usage information.

  2. Transaction Information -When you complete a transaction through our site we collect information about that transaction including the amount, nature of the transaction and date and time of that transaction.

  3. Information Collected through tracking technologies -Together with our service providers we use technologies such as cookies, flash cookies and web beacons to automatically collect certain usage and device information when you access our service and interact with our emails.

b). Information you Provide Directly to Us

We directly collect information provided by you to us including instances you register and interact with our service, visit our offices, participate in our marketing activities (ranging from surveys, promotions, webinars and events)

c). Information Collected from Public Sources

During your interaction with our service, we may collect information from public records held by government authorities and information submitted in public forums or published on social media networks.

d). Information Collected from Your Friends, Colleagues or Employer

We may collect personal data of our current, past and prospective customers as part of our marketing strategy. We may also receive your personal data from a friend or third party who knows you as part of a referral.

We also obtain information about you from other 3rd parties such as third-party service providers, companies we do business with such as name and contact data, inferences about your preferences and attributes, inferred fraud risk from identity and fraud prevention partners, companies we partner with to promote our service offerings, data brokers, social media networks (Including widgets of those networks i.e. like and retweet buttons, advertising data-from our ad campaigns or other platforms)


We may use the information we collect separately or in combination for the purpose enumerated below.

4. HOW WE USE YOUR INFORMATION

We use the information we collect for the purposes enumerated below or as otherwise explained to you at the collection points;

  1. To maintain and provide services to you-z We may use the personal information you provide to create, maintain, customize and secure your account and enable you to access the site and services, maintain and improve the services, process and complete your contact and support requests and send you relevant information including purchase confirmation and invoices, diagnose, repair and track service and quality issues, provide security alerts, to personalize your user experience and to respond to any inquiries and complaints.

  2. To help protect the safety and security of our services, business and users such as to investigate and help fraud prevention or any other illegal activity.

  3. To comply with applicable laws and lawful obligations- We may use your information to comply with legal requirements or to defend legal claims against us, this information could also be collected for safety purpose that could involve collection and processing of personal data (i.e. health data) for office visits and any of our events for purpose of complying with public health needs and requirements or as required by the law.

  4. To perform market research or conduct surveys unless you request that you do not wish to participate- This may include us sending you marketing, communications and product recommendations about our service offerings, news and events. We may use your personal information when you opt to participate in questionnaires, promotions, product feedback, events, surveys. You can opt out of marketing communications or by clicking the unsubscribe link at the bottom of our marketing communications.

  5. To fulfil any purpose for which you provide and consent to.

  7. To provide you with notices about your account.

  8. To fulfil corporate transactions such as sales, mergers and acquisitions e.t.c so as to fulfil requests of a prospective purchaser who may be interested in purchasing our companies' assets.

  9. To fulfil a referral request- If you elect to use our referral service to recruit someone to use our services, we will use the personal information provided to contact the person so long as they will have no objection to Dial Afrika contacting them.

  10. To fulfil our own business purpose -We may use your personal information to audit the usage and perfomance of programs you interact with in our site to evaluate and improve your interaction with us, to design and improve on the service offerings, to perform internal research for development and improvement of our technology, to conduct data analysis and testing and in all cases to maintain proper business function.

  11. Depending on any relevant applicable law, when we convert the data to an anonymized aggregated data it may not be personal data anymore and we may use the information for any legal purpose.

5. DISCLOSURE OF INFORMATION

We are forthright and committed to maintaining your trust and thus we believe it's imperative you understand when and with whom we share information about you. We may disclose personal and business information we collect to the below recipients;

  1. Our Subsidiaries and Affiliates -Where necessary we share your personal information with companies owned or controlled by us which includes our parent and holding companies, affiliates, subsidiaries and companies we acquire. The companies will process any information shared in the manner enumerated in this policy.

  2. Authorized Third party Vendors and Service Providers -We may share your personal information with third party vendors or service providers that are working for us i.e. IT service providers, Our hosting providers, Internet service providers, data analytic companies, marketing providers. We may also share the information with third party vendors who perform services for us i.e. identification verification, fraud prevention, advertising, tax and accounting service providers. The information may also be shared with third-party vendors who assist us in fulfilling your orders and requests i.e. credit card and payment processors

  3. Business Partners -We may provide your personal information to our business partners for their own purposes. These may include;

  • To our subscribers
  • To third-party networks and websites for marketing and advertising purpose
  • To reseller partners (These are individuals or companies that market and sell products for us) to enable them notify you about our services. The partners will be required to provide an opt out option in their communication to you
  • To event sponsors we work with
  1. In relation to Corporate Transactions -We may share information about you in relation to fulfilling a corporate transaction being a merger, acquisition, reorganization or in the unlikely event of a bankruptcy.

  2. In relation to Fulfilling Legal Purposes -We disclose information about you if we reasonably believe the disclosure of the information is in accordance with or required by any applicable law to protect the rights, safety and security of Dial Afrika, the public and our users.

  3. Professional Consultants- We may share your personal information with our various professional consultants i.e. accountants, auditors and lawyers

  4. Public -Should you provide feedback, testimonials or make public comments regarding our service offerings we may post your personal details including your name with your consent. We may post anonymous testimonials and content feedback without your consent. Our site may have community forums, comment sections, discussion forums wherein you may post or comment, such information may be read, collected and used by other parties apart from us who access it.

  5. Information Shared with your consent -We share information about you for any other purposes disclosed to you with your consent. If legally permitted we share information with others in an aggregated and de-identified form that doesn't identify you.

6. COOKIES AND THIRD-PARTY TRACKING TECHNOLOGIES

We and our authorized partners collect information via cookies, web beacons, pixels, tags, embedded scripts or other data retrieval and tracking technologies i.e., device identifiers, browser type, operating system, IP address, Internet service provider, your Wi-Fi mac address or Bluetooth Mac address, date and time of your access.

This technology tells us how many visitors clicked on key elements (such as links or graphics) While using the Site, we do not use this technology to access your personally identifiable information on the Site; it is a tool we use to compile aggregated statistics about Site usage. We may share aggregated Site statistics with our business partners but do not allow other companies to place clear gifs on the Site.

Equally, we directly or in conjunction with our third-party partners use tracking pixels to help us manage content better by improving the user interface or improve our sales and marketing programs for you. In comparison to cookies that are stored in the users computer, tracking pixels are embedded invisibly on web pages. Our site may use information reports regarding user demographics, traffic patterns and purchases. The tracking information may be linked with personal data.

  3. Where we are in control of your personal data, we will retain it for as long as necessary to fulfil purposes enumerated in section 4 of this policy.

In instances we have no legitimate business need or any legal ground to process the personal information provided to us, we will take all reasonable steps to delete or anonymize and where this is not possible, we will secure this personal information data and isolate it from further processing until deletion is possible.

9. CORRECTING INFORMATION

You can review and change your personal and business information at any time by logging into the site and changing it on your account profile page.

You can also reach out to info@dial-afrika.comrequesting access to, correction or deletion of any personal or business information you have provided to us. In some instances, it may not be possible to delete your information except by deleting your account as well.

Where for legal or compliance reasons we may decline to approve a request to correct or change information where we believe such change would violate a law or legal requirement or cause provision of incorrect information.

10. INFORMATION ON CHILDREN

We do not knowingly collect or solicit information from individuals under the age of 13 nor do we send request for personal information to them. In the event we learn that we have inadvertently collected such information from a child, we will take reasonable steps to delete that information. 11. TRANSFER OF INFORMATION

We store and process your information in Kenya and United States of America or any other country in which Dial Afrika or its subsidiaries and affiliates maintain facilities. By accessing and using our site, you acknowledge and consent to the transfer, storage or processing of information outside of your country. Various jurisdictions moreso in the European Economic area have data protection laws and regulations placing restrictions on such transfer and we are committed to comply with them. However, your use of our site and provision of such information should be in compliance with the applicable data protection laws and regulations in your jurisdiction.

12. CHANGES TO THIS POLICY

This privacy policy will evolve with time and when we update it, we will revise the last update below and post the new policy, in other instances we provide additional notice (such as adding a statement to our site) Kindly review the policy on a regular basis as you access our services to keep updated on our privacy practices.

13. SUPPLEMENTAL PRIVACY NOTICE FOR USERS IN THE EEA, UK, AND SWITZERLAND

With respect to individuals who are based in the EEA, Switzerland or the UK, these European Privacy Notices are incorporated and made a part of our Privacy Policy, and the terms of these European Privacy Notice shall control in the event of any inconsistency. We process personal data on the following legal bases: (1) with your consent; (2) as necessary to perform our agreement to provide Website (such as when you become a Subscriber); and (3) as necessary for our legitimate interests in providing the Website where those interests do not override your fundamental rights and freedoms related to data privacy.
